These Terms of Service ("Terms") are an agreement between you and Keller Tech LLC, doing business as Banked Embers ("we," "us," "our"), for your use of the Subtext mobile app and related services (the "Service"). By downloading, installing, or using Subtext, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old, or the minimum age of digital consent where you live if that age is higher, to use the Service. If you are under 18, you may use Subtext only with the involvement of a parent or guardian. By using the Service, you confirm that you meet these requirements.
Subtext analyzes the words in a conversation you bring to it and returns a score, a few short pattern flags, a brief summary, and a suggested next move. The output is informational only. It describes patterns in a thread, it does not judge people, and it does not label anyone with a condition or a diagnosis. AI can misread tone, sarcasm, and context, so treat every reading as one perspective, not a verdict or a fact.
You keep all rights to the messages and conversations you bring to Subtext. We do not store your message content, contact names, or media on our servers, and your analysis results live on your device. How we handle data is described in our Privacy Policy, which is part of these Terms. You can delete your server-side data at any time from the app or at our data deletion page.
Subtext offers a free tier and paid options, including subscriptions and one-time purchases. Purchases are processed by the Apple App Store or Google Play, not by us, and are subject to those stores' terms. Subscriptions renew automatically until you cancel, and you cancel through your App Store or Google Play account settings. Prices, billing, and refunds are handled by the applicable store. We do not separately process payments or issue refunds.
The Service, including the Subtext name, the app, its design, and its content, is owned by Keller Tech LLC and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service under these Terms. You may not copy, resell, or create derivative works from the Service except as the law allows.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that any reading will be accurate or reliable. Subtext is not a licensed professional and does not provide medical, mental health, legal, or financial advice.
To the fullest extent permitted by law, Keller Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or reliance on, the Service or any reading it produces. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or twenty US dollars.
You agree to indemnify and hold harmless Keller Tech LLC from any claims, losses, or expenses, including reasonable legal fees, arising from your misuse of the Service or your violation of these Terms or of any law or third-party right.
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms. If we make a material change, we will update the date above and, where appropriate, notify you in the app. Your continued use of the Service after a change means you accept the updated Terms.
You may stop using the Service at any time by deleting the app. We may suspend or end your access if you violate these Terms or use the Service in a way that could harm others or us. Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability, and indemnification, will survive.
These Terms are governed by the laws of the United States and the state in which Keller Tech LLC is organized, without regard to conflict-of-law rules. Any dispute will be brought in the courts located there, unless a binding consumer-protection law in your home jurisdiction provides otherwise.
